Our terms of sale

1. Definition of parties.

The seller is Montessori Care AS, Org no. 926 715 259, Kristianiasvingen 74, 0782 Oslo, Norway. E-mail: post@montessori-care.com, telephone: 99585035, hereinafter referred to as the seller, we or us.
The buyer is the person or business stated as the buyer in the order, and is hereinafter referred to as customers, buyer, you, you, your or yours.

2. General Terms and Conditions.

The terms of purchase apply to the purchase of goods and services from www.montessori-care.com and its sub-pages and other sales channels.
The terms of purchase and your order, confirmed by order, constitute the overall contractual basis for the purchase. Consumer purchases are regulated in, among other things, the Consumer Purchases Act, the Right of Cancellation Act, the Marketing Act, the Personal Data Act, the E-commerce Act and the Credit Purchases Act.
All prices include VAT or are VAT-free and without shipping unless otherwise stated. The total cost will be determined before the order is placed, and includes all expenses associated with the purchase. We reserve the right to refuse delivery of all goods based on printing errors, incorrect pricing, competitive conditions and all other reasons.

3. Payment

The customer chooses the payment method himself. Payment is processed by the various suppliers. Trade with Via or Mastercard is processed by Klarna. Klarna is responsible for our invoice and partial payment solutions and processes these orders. Vipps processes the orders that go through its solution. All are highly secure electronic payment providers. All information entered into our Checkout, both personal and card information, is encrypted and secured to the highest standards. As an end customer, you can be confident that your information will not go astray, and that it will never be shared with third parties.

For digitally downloadable products, the item is paid for directly, as you get access to the download immediately. We have no right of return for digital products.

4. Delivery and delay.

For physical products we have in our main warehouse, we have a delivery time of 14 working days, depending on where you are in the country. For ordered goods, the delivery time will be stated in a possible offer. The shipping cost falls to the customer and varies with respect to where in the country, as well as how much is to be sent. Prices are given during the purchase process. When the package has been sent, you will receive confirmation per e-mail. The package must be picked up at your local post office before it is sent back to us. If the package is not picked up at the agreed place and the customer wants a new delivery, the costs will be new dispatch usually falls to the customer. Unclaimed packages are charged a fee of 250,- plus shipping. This is to cover costs for return shipping, handling and packaging.

The customer himself is responsible for providing the correct address and mobile number so that we can notify you when the package is ready for delivery.

Risk for the products is assumed by the customer as soon as they leave our premises. When the customer receives the goods, the delivery should be examined to ensure that the goods are in accordance with the order confirmation, whether the products have been damaged during transport, or have other errors/shortcomings.

7. Exchange/right of withdrawal

According to the Right of Cancellation Act, the cancellation period of 14 days applies to online, in-person courses and all physical products. The right of withdrawal cannot be used after the start date of the course. You get access to digital products immediately, and you therefore do not have the right to cancel the purchase, cf. the Right of Cancellation Act §22 letter n. If you wish to make use of the right of cancellation, the item must be returned in the same condition as it was received and with a completed right of cancellation form. The customer will, after an approved return, be refunded what has been paid. Return postage is paid by the customer. See additional information on the right of withdrawal form. 8. Complaint

If there is a defect in the product, notification must be given within a reasonable time per email about this. The customer will then be given further guidance on how to carry out a complaint. The rules on complaints can be found in the Consumer Purchase Act.

9. Disclaimer

We strive to provide our customers with as correct information as possible, but reserve the right that typing/printing errors may occur. In the event of sold-out situations, we reserve the right to cancel all or part of the order. In such situations, we will do what we can to find alternative solutions. Images used on our pages are illustrative and may differ from the actual appearance of the item.

10. Personal data and other information.

We are very concerned that personal data is handled in a secure manner. In the main, we only process information that is necessary for us to be able to carry out our obligations towards the customer. In connection with accounting, tax handling and return/warranty handling, we are required to store e.g. name, address and email. Credit card numbers are handled by qualified payment service providers. Purchase history and log data are used to learn more about what our customers are interested in, as well as improve offers and selection. Montessori Care AS does not sell personal data to third parties and all information is handled confidentially. We offer communication via e-mail and telephone. Receiving this is voluntary and you can easily sign up at any time. We reserve the right to be able to send out material by post to registered customers.

11. Customer's obligations

As a customer, you are responsible for paying for the services the seller delivers in accordance with the current terms and conditions. The responsibility also includes other people's use of access (unauthorized use), as long as it cannot be demonstrated that this was made possible by negligence on the part of the seller. It is the customer's responsibility that the mobile number and email are correct so that we can notify you when your package is ready for delivery.

12. Change in the terms

The seller reserves the right to change the current terms.

13. Extraordinary conditions

The seller is not responsible for indirect losses as a result of defects etc. if the loss is caused by gross negligence or intent on the part of the seller.

14. Force Majeure

Is the delivery or redelivery unreasonably burdensome as a result of a labor dispute or any other circumstance beyond the control of the parties, such as fire, war, mobilization or unforeseen military calls-up of a similar scale, requisition, seizure, currency restrictions, riots and riots, shortage of means of transport, general shortage of goods, as well as shortages or delays in deliveries from subcontractors or manufacturers as a result of such circumstances as are dealt with in this point, the seller is exempt from all liability other than in cases of complaint and credit it to the corresponding purchase price of the defective goods.

15. Copyright

All content on Montessori Care AS belongs to Montessori Care AS or a subcontractor of said property, and is protected according to, among other things copyright, marketing and trademark laws. This means that all information, designs, images and graphics cannot under any circumstances be downloaded, copied or used without special prior written consent from Montessori Care AS.

16. Disputes

The parties shall attempt to resolve any disputes amicably. If this is not successful, the case can be brought before the Consumer Council under Norwegian law.

17. Complaints and returns

Risk for the products is assumed by the customer as soon as they have left Montessori Care AS premises. After the customer has received the goods, the delivery should be examined as soon as possible to ensure that; the consignment is in accordance with the order confirmation, whether the products have been damaged during transport or have other errors/shortcomings.
If there is a defect, error or damage to the product, written notification must be given within a reasonable time by email (post@montessori-care.com). In the email, we ask you to indicate the order number, as well as which product names the complaint applies to. Attach photos that clearly show the lack/error/damage.
At Montessori Care AS, we have a right of withdrawal for up to 14 days from when you have received the item. If you wish to make use of the right of withdrawal, the item must be returned in the same condition as it was received and with a completed right of withdrawal form. As soon as the return has been approved, you will be refunded the applicable amount. Costs associated with returns are paid by the customer.

1. Introduction

We at Montessori Care AS take privacy seriously and process your personal data in a safe and responsible manner. The website Montessori-Care.com is operated by Montessori Care As, which is committed to protecting your personal data and informing you about how we used your personal data.

2. Processing of personal data

When you use our website and/or are in contact with us by ordering goods from us, Montessori Care AS will process personal data about you. Below you will find information about the personal data that is collected, why we do this and your rights related to the processing of the personal data. Why do we collect personal data and what kind of information do we collect? We collect and use personal data for various purposes depending on who you are and how we come into contact with you. We collect the following personal data for the purposes stated below:
Responds to inquiries that come to us. Name, telephone number, e-mail address and any personal information that may result from the inquiry. The processing of personal data takes place on the basis of an ingress assessment where we have assessed what information is necessary to help you with what you are wondering about.
In order to obtain information about the use of our websites, we use cookies. You can read more about cookies and which cookies we use. However, we safeguard your privacy by only using the information for statistics. In these statistics, it is not possible to identify you as an individual.

3. Disclosure of personal data to others

We use Google Analytics to be able to improve the website for our users. Google Analytics collects data about user behavior on the website in the form of clicks, search terms and which links have been used to get to the page, but does not collect sensitive information about the user himself.
Beyond this, your information is not shared.

4. Storage time

We store your personal data with us for as long as is necessary for the purpose for which the personal data was collected. This means, for example, that personal data that we process on the basis of your consent will be deleted if you withdraw your consent. Personal data we process to fulfill an agreement with you is deleted when the agreement has been fulfilled and all obligations arising from the contractual relationship have been fulfilled.

5. Your rights

You have the right to demand access, correction or deletion of the personal data we process about you. You also have the right to claim limited, object to the processing and claim the right to data portability. You can read more about the content of these rights on the Norwegian Data Protection Authority's website: www.datatilsynet.no. To exercise your rights, you must contact customer service by e-mail post@montessori-care.com. We will respond to your inquiry as soon as possible, and at the latest within 30 days.
We will ask you to confirm your identity or provide additional information before we allow you to exercise your rights with us. We do this to be sure that we only give access to your personal data to you - and not to someone pretending to be you.

6. Changes

Should there be a change to our services or changes to the regulations on the processing of personal data, this may result in changes to the information you have provided here. If we have your contact details, we will make you aware of these changes. Otherwise, updated information will always be readily available on our website.
